How To Apply For Canada’s New TR To PR Open Work Permit?

Canada just published a simple primer on how essential employees and international students can apply for an open work visa.

Few guidelines have been issued by Immigration, Refugees, and Citizenship Canada (IRCC), particularly for those who have applied for the new temporary residency to the permanent resident pathway. The formal guidelines had been posted online by the Canadian immigration agency.

Six new temporary residents to permanent residence routes programs were established recently in May to provide immigration pathways primarily for international student graduates, French speakers in Canada, and critical workers.

Those who qualify for the new immigration program must have temporary resident documents in Canada, such as a study or work permit. The new open permit is mostly for people who have applied for immigration programs and have less validity on their current documents. This employment serves as a bridging open work permit, allowing candidates to remain in Canada while their application is reviewed by Immigration, Refugees, and Citizenship Canada.

These work licenses will be valid just until December 31, 2022. Assume the candidate’s immediate relatives, such as a common-law partner or dependent child, are over the age of 18 and currently reside in Canada. In that situation, they may also seek a permit.

Which programs does it apply to?

The new work permit mostly pertains to the temporary resident-to-permanent residence pathway. There are six programs, three of which have an intake cape and are open to English speakers. The remaining three programs are only for French speakers and have no application deadlines.

The following programs, together with their quotas, are listed:

  • Those employed in Canada – Stream A for health care workers (20,000 applications)
  • Individuals in Canada – Stream B for critical non-healthcare workers (30,000 applications – Full)
  • For international graduates – 40,000 applications received – Full)
  • Stream A is mostly for French-speaking health care personnel in Canada (no cap)
  • Workers in Canada – Stream B is mostly for important non-healthcare workers who speak French (no cap)
    International grads who speak French (no cap)
  • All newly available programs are set to become live on November 5th, or until IRCC receives the maximum number of applicants for each program.

There are currently only overseas graduate programs available, and all paths for important employees in non-healthcare professionals have been filled.

When can TR to PR applicants apply?

TR to PR applicants can apply four months before their existing temporary status expires, according to new announcements from Immigration, Refugees, and Citizenship Canada (IRCC). A family member of the applicants may also apply for the permits at any time. Applicants can, however, apply for the permit at any time if they are currently on the maintained status or are qualified to regain it.

How do you apply?

The only option to apply for the passes is to do so online. You are unable to apply for the passes at the port of entry. If you are unable to apply for permits online owing to a handicap or a poor internet connection, please contact us. In such a circumstance, IRCC permits the applicant to submit a paper application as well.

Step 1: Get everything you need
To apply online, you must have all of the necessary tools on hand, such as a scanner or a camera. However, you must have your debit or credit card on hand to pay the fees.

To fully fill out the forms, you must first review the IRCC’s official release instructions; you will need an Adobe Acrobat reader installed on your computer.

Step 2: Make your payment.
By visiting the government’s official website, the applicant will be needed to pay the $155 work permit extension charge. This is because you are excused from paying the $100 open work permit holder’s fee that you must pay before applying online.

Step 3: Sign in to your IRCC account.
Before you begin applying online, make sure you have an IRCC account. You can use this account to submit your application form and check the status of your application.

After you’ve signed into your account, you’ll need to go to the “Start your application” area on the account home page. After that, you must click on the “Apply to come to Canada” button. After completing the preceding step, scroll down to the “I do not have a personal reference code” section. After that, click the “Visitor visa, study and work permit” button. The final step is to proceed to the next page and select “work.”

Step 4: Obtain a document checklist
After successfully creating your account, you will be prompted to answer a few questions in order to receive your personalized document checklist.

Assume you want to work in Canada for a period of more than six months. However, when asked, “What is your current immigration status in Canada?” both students and workers must select “worker.”

Select “I am applying for an open work permit under an active public policy or pilot program declared by IRCC” if you are asked which scheme applies to you.

Following that, you’ll be asked, “Are there any fees related to this application?” Do you have to pay the fee or are you exempt? Finally, you must respond, “No, I am exempt from paying the application fees even if I have already paid the $155 price but am not exempt from paying for the open work permit holder.”

Step 5: Complete the forms
The IRCC’s official instructions will assist you in filling out the form after you have followed all of the guidelines for the document checklist.

The IMM 5710 form, commonly known as “Application to Change Conditions or Extend my Stay or Remain in Canada as a Worker,” is one of the necessary paperwork. To begin, select “Open Work Permit” in the “Details of Intended Work in Canada” area of dialogue box 1. Then, in Field 4, in the Job Title box, type “TRPR route PP OWP.” Then, in the “Brief description of duties” box, enter the name of the PR stream you’ve applied for.

You can request the ending date for the “timeframe of the projected employment,” which shall not be later than December 21, 2022. Furthermore, you cannot request a date that is later than the passport’s expiration date.

Step 6: Upload the necessary documents.
The photocopy of your fees receipt, any valid evidence proving that you were previously working lawfully when you applied for the work permit, a photocopy of your passport, a digital photo, Family information form, test results, and proof of language are some of the documents that you must include as the principal applicant.

You may also be asked to have a medical checkup and submit a medical report, as well as a number of other documents, such as marriage certificates or birth certificates, for any family members accompanying you.

Following the application

The immigration officer will completely analyze your application when you have successfully applied for it. To confirm that you are eligible, the officer will review your employer’s compliance record. They also make certain that you are eligible to apply for a work visa.

If the officer discovers that your application is incomplete, it will be returned without being processed. However, the immigration officer may also request extra information.

Furthermore, imagine you are qualified and your application is accepted. In that instance, the Canadian government would ship the work permit to your registered Canadian address, which you provided when you submitted your application. The work permit will include information about the sort of work you are eligible for, the employer for whom you will work, the work location, and the length of time you can work.
